There are two types of assault defined by Maryland law:
First degree assault is a felony under Maryland Criminal Code § 3-202.
Second degree assault is a misdemeanor under Maryland Criminal Code § 3-203.
First degree assault is the intentional or attempted serious physical injury to another; or assault with a firearm.
Second degree assault is the intentional frightening of another person with the threat of immediate offensive physical contact or physical harm; or
the battery or attempted battery of another person.
There are effective defenses to assault charges such as self-defense, defense of others, and spousal privilege. We are well-versed in these defenses, and are able to prepare and present them to the Assistant State’s Attorney, judge, and even a jury.
